Fees & Policies


Hourly Rate

An hourly rate of $225.00 per party applies to all two party sessions. This rate applies to time spent by the neutral at the session, in addition to preparation/review in advance of the session, and follow up negotiation, including teleconferences, e-mail and/or written correspondence.



TRAVEL

Travel time is billed only when non-local travel is required by the neutral for all travel to and from locations outside of Boston or Quincy, MA.



MEDIATION SCHEDULING

Parties may schedule mediation session time with NEMA principals in either ½ day or full day (9:00am - 5:00pm) blocks. Please contact our office to discuss flexibility for ½ day (morning or afternoon) sessions.

For a ½ day session, NEMA requires prepayment of the fee for the session ($895.00 per party for a 2-party ½ day mediation). Please contact our office to discuss multi-party mediation fees.



ARBITRATION SCHEDULING

Parties may schedule arbitration hearing time in 2-hour blocks. NEMA requires prepayment of the fee for all hearings ($450.00 per party). Additional time for documentation review/analysis will be billed on an hourly basis ($225.00 per party, per hour).



CANCELLATION/POSTPONEMENT FEES

For cancellations or postponements made within 14 calendar days of a scheduled session, NEMA will assess a fee of 50% of the session fee owed by the cancelling/postponing party. For cancellations or postponements made within 3 business days of a scheduled session, NEMA will assess a fee of 100% of the session fee owed by the cancelling/postponing party. If responsibility for a cancellation or postponement is unclear, the fee will be split between the parties. Cancellation fees will be assessed only if the neutral’s time cannot be assigned to another case.



PAYMENT POLICY

Each party's fee is due 10 business days before the first session. Checks should be made payable to Northeast Mediation & Arbitration, LLC (Federal ID: 51-0612252). Unless otherwise instructed in advance, all billing will be directed to counsel. Counsel and parties are jointly responsible for payment of all fees
